  • Property managers are required to provide tenants of rental properties with operation manuals, testing, and no tamper instructions for all installed alarms.

General Information

  • An electrical safety check for all landlord-provided electrical appliances, installations and fittings is now mandatory every 2 years.
  • The safety check must be carried out by a licensed or registered electrician in accordance with the Australian and New Zealand Standard for Electrical Installations—periodic variation (AS/NZS 3019:2007). The service must be amended when these variations update at any time.
  • Tenants of rental properties now have the right to request the date of the last electrical safety check.
  • If not checked within the last 2 years, an electrical safety check is required as soon as practicable after the renter occupies the property.
  • Detailed records must be kept including the name and licence or registration number of the electrician who conducted the check, the date of the check, the results including any repairs required and actions taken, and a report prepared in accordance with section 2 of AS/NZS 3019. The record must be kept until a record of the next check is available.
  • Tenants of rental properties have the right to ask for a copy of the record and must be supplied within 7 days of written request.

Gas And Electrical Safety Obligations

Under the new laws rental providers (previously referred to as landlords) have certain responsibilities for gas and electrical safety.

Rental providers must undertake gas and electricity safety checks:

  • For all new agreements after 29 March 2021, or

  • Where there is a fixed term agreement of more than five years which rolls over into a periodic tenancy after 29 March 2021, must undertake gas and electricity safety checks.

Additionally, rental providers must keep, and be able to produce, records of gas and electrical safety checks conducted at the property.

A new financial, administrative and practical burden for landlords

Under the new regulations, renters have the right to request the date of the last safety service for both gas and electrical. There is an obligation to complete a service ‘as soon as practicable’ when a new renter moves into a property that hasn’t had a check for 2 years or more.

Proper documentation have become a critical protection for landlords and property managers, with records maintained meticulously to show that you’ve met your obligations around services and notification of tenants.

Evidence Of Safety Checks

GAS SAFETY CHECK

The gasfitter should provide a record of the gas safety check. The document must include:

  • Their full name and business details, including licence or registration number of the gasfitter who performed the check
  • the date the safety check was conducted, and
  • the results of the check, including any servicing and repairs required and actions taken to address the repair.

Additionally, rental providers must keep, and be able to produce, records of gas and electrical safety checks conducted at the property.

ELECTRICAL SAFETY CHECK

The electrician should provide a record of the electrical safety check, which must include:

  • Their full name and business details, including the licence number of the electrician or REC who performed the check
  • the date of the safety check
  • the results of the check, including any repairs required and actions taken to address the repair, and
  • confirmation that all installations and fittings have been checked and found safe.

Additionally, rental providers must keep, and be able to produce, records of gas and electrical safety checks conducted at the property.

Record Keeping

A record of the most recent gas and/or electrical safety check, along with the details of the tradesperson who performed the check, must be kept until a record of the next safety check is created.
A copy of the most recent gas or electrical safety check will be provided to the renter within seven days after the rental provider receives a written request from the renter.

GAS SAFETY CHECK

A record of a gas safety check can be either of the following:

  • a compliance certificate (if applicable)
  • a document from the licensed gas fitter who carried out the safety check.

ELECTRICAL SAFETY CHECK

A record of an electrical safety check may be any of the following:

  • a compliance certificate
  • a document or checklist from the electrician or REC
  • an ‘’Electrical Installation audit report’
